WHAT IS A WORK PERMIT?
A work permit is a legal document issued by a competent Vietnamese government agency that allows a foreigner to legally work in Vietnam.

Nature of a Work Permit:
A work permit for foreigners is a type of license issued by an authorized state agency in Vietnam. It evaluates whether a foreign national meets the legal conditions to work in the country. This process ensures that the foreign worker meets requirements related to qualifications, skills, health, and is not prohibited under the Labor Code and its guiding documents.
Authorities Issuing Work Permits:
According to Article 3 of Circular 40/2016/TT-BLĐTBXH, the agencies responsible for issuing work permits are:

Ministry of Labor, Invalids and Social Affairs (MOLISA): Issues permits for foreigners working at diplomatic missions, consular offices, representative offices of international organizations in Vietnam, and other cases as regulated by the Minister of Labor.

Department of Labor, Invalids and Social Affairs (DOLISA): Issues permits for foreigners working in provinces and centrally-run cities.
Contents of a Work Permit:
The work permit includes detailed information about the foreign worker, such as:

Full name, passport number, date of birth, nationality

Name and address of the organization or company where the foreigner works

Job position and profession

Validity period of the work permit
Validity of the Work Permit:
A work permit is valid for a maximum of 2 years.
Procedure for Applying for a Work Permit:
1. Required Documents:
The application dossier includes:

Application form (as per the official template)

Passport copy: Valid for at least 12 months

Health certificate: Issued by a qualified Vietnamese medical facility within the last 6 months

Degrees and certificates: Proving professional and technical qualifications appropriate for the job

Criminal record certificate: Issued by the competent authority of the country where the foreigner is a citizen

Passport-sized photo: 4x6 cm, white background

Labor contract or employment agreement: Signed between the foreigner and the Vietnamese employer

Document confirming the need to employ a foreign worker: From the enterprise
2. Application Process:

Step 1: The employer submits the application dossier to the Department of Labor, Invalids and Social Affairs (DOLISA) where the company is based.

Step 2: DOLISA reviews the dossier for completeness and validity.

Step 3: Within 5 working days from the receipt of a complete application, DOLISA issues the work permit.
